The Sixteenth Amendment expressly аuthоrizes Cоngress “tо lаy аnd collect taxes on incomes, from whatever source derived …”.   Moore has a multi-million-dollar investment in a company, but rather than take the revenues generated by the company for his owner personal use, he reinvested that money back into the company.  Prior to 2017, this reinvestment was not considered for tax purposes.  In 2017, Congress passed new tax laws including a provision that treated Moore’s initial receipt of revenue from the company as taxable income even though he reinvested the entire amount back in the company.  Moore argues this taxation violates the 16th Amendment because the money he received from the Company was not income and would subject the wealthy to different taxes than those with lower income. The 16th Amendment was adopted after the Supreme Court overturned decisions dating back to 1793 that concluded that Congress could tax wealth and could do so even though it required the wealthy to pay more than the poor.  In 1895, the Supreme Court overruled over a hundred years of precedent in a 5-4 decision.  In Pollock v. Farmers’ Loan and Trust, the Court concluding that Congress does not have the authority to create a system of progressive taxation where taxpayers were treated differently based upon their wealth.  To overturn this and a similar Supreme Court decision that followed, Congress proposed, and the States ratified the 16th Amendment to expressly grant Congress the power.  While it is not stated in the Amendment, the historical record is clear that the Amendment was proposed and adopted to specifically to overturn Pollock.  With any knowledge or discussion of the specific case, tax law or theories of income, explain how this question would be addressed and the 16th Amendment interpreted based upon the competing theories we discussed in class.  While you have no direct authority on this question, throughout the semester we have discussed Strict and Broad construction as a means of interpreting the Constitution.  In your opinion, how should the 16th Amendment be interpreted.  Be sure to explain and support your opinion with reference to at least three opinions included in your readings.
