Bоb drоve intо а gаs stаtion to refill his gas tank. At the pump, a clear and conspicuous sign read, “Caution: gas produces flammable vapors. By local ordinance, you must shut off your engine while you pump gas.” A second sign read, “Cell phone use prohibited.” Bob did not shut off his engine, and he used his cell phone for texting and browsing social media while he was filling his tank. Distracted by his phone, he turned his back to the car and didn’t notice that the car was still in gear and slowly beginning to move. A few moments later, Bob heard a crash and a scream, and when he turned around he saw that his car had driven through the glass window of the gas station’s convenience store. There were no bollards (yellow painted poles) preventing a car from crashing through the storefront window. Judy had been waiting in line to pay for her gas and was pinned under Bob’s car. Judy was seriously injured. She was taken to the hospital for emergency care, which included surgery. She had never had surgery before. Six months later, she was feeling very unwell and experiencing frequent infections and other symptoms. A subsequent medical evaluation revealed that a surgical sponge was present inside Judy’s abdomen. She needed another surgery to remove the sponge. Her aftercare included several rounds of IV antibiotics to treat a life-threatening infection bordering on sepsis, which she needed to receive in the ICU at the hospital. While in the ICU, Judy developed a staph infection at her incision site, which spread to a minor cut on her dominant hand. The staph infection did not heal, due to her weakened immune system from the severe infection, and she developed toxic shock syndrome. She was intubated, placed in a medically induced coma, and woke several weeks later with permanent brain injuries. Her infected hand ultimately healed, but she lost 20% functionality in her hand and no longer could play her violin. Discuss Bob’s liability to Judy in a negligence cause of action, including what damages Judy will recover.
