A grаduаting high schооl student, Tim Jeffersоn, hаs sued in federal district court seeking to declare unconstitutional and to permanently prohibit the inclusion of prayer at graduation. The school board of Tim's school had authorized student elections to permit students to decide whether to include a voluntary, nonsectarian, student-led prayer in their graduation ceremony.  By a majority of one, the students voted to have such a prayer. The most recent decision on this issue is Lee v. Weisman, 505 U.S. 577 (1992). In Lee, a middle school principal had invited a member of the local clergy to offer a nonsectarian and non-proselytizing* prayer at his school's graduation. The Court said that the principal's invitation represented governmental coercion to participate in religious activities, a form of establishment of religion barred by the first amendment.  *"proselytizing" means "attempting to convert."

Cоnsider the fоllоwing stаtements interpreting Lee v. Weismаn аs precedent for this case.  (1) "The case at hand is constitutionally indistinguishable from Lee v. Weisman under Lee's coercion analysis. The recitation of a prayer under the special circumstances of a public school environment and a graduation event itself will have the same coercive effect here as in Lee." (2) "The Lee decision declined to ban prayer under all circumstances at graduate ceremonies and rested its analysis on the coercive effect of the direct involvement by the school principal. In the case at hand, the School Board's policy assigned a passive role for school officials and so removes the establishment clause problem identified in Lee." QUESTION: Statement (2) is written to benefit the plaintiff.
