ESSAY #2 (One Hоur) Peter is the оwner оf Honest Legаl Prаctices, а large products liability firm. He recently renovated the firm with marble flooring and walls. One day, Peter noticed that one of the marble tiles was coming up off the floor and was not “sticking to the floor” as it should. Rather than calling the company that installed the marble tiles, Peter decided to fix it himself. Peter went to Fix-It-Yourself, a large office and home improvement store, and purchased a handheld heating device manufactured by Hotness. The device came with glue manufactured by Sticky. The glue, in its hardened form, had to be inserted at the back of the device and then hot melted glue would come out the front. Peter took the device back to the office and started to assemble the device. The glue that Peter purchased was clearly labeled “Keep Dry”. Although no instructions or warnings came with the glue, Hotness included several warnings throughout the instructions to the device stating, “If using dry glue, avoid any moisture on the glue when inserting to avoid risk of malfunction.” No other warnings relating to the glue were included with the device. The device had a “hold switch” located on the handle. The “hold switch” had to be pressed in order for the device to turn on and operate. Before operating the device, Peter went to the bathroom to wash his hands and came back with wet hands. As Peter started to place the glue into the back of the device, the water from his hands dripped onto the glue. Peter started to place melted glue on the floor where the tile had come off with the device. Soon thereafter, Peter started to smell a foul odor coming from the device. He turned the device off by taking his hand off of the “hold switch”. Unbeknownst to Peter, the wet glue had caused the glue to not properly melt and clog the vents releasing excess heat. After careful examination of the device, Peter did not notice anything wrong and could not figure out what was causing the foul odor. Peter decided to continue placing melting glue on the floor. Within seconds, the device started to emanate a burning smell and started to vibrate. Peter took his hand off of the “hold switch” again, but the “hold switch” became stuck and continued to pour melted glue. When Peter shook the device to see if it would loosen the “hold switch”, the device exploded in his hand causing severe and permanent injuries to his hand and face. On what theory or theories might Peter receive damages from, and what defenses may reasonably be raised by: 1. Hotness 2. Sticky 3. Fix-It-Yourself
