In any case, the appeals to Genesis 1-2 can be considered apart from the setting in a controversy with Pharisees. Given the authenticity of some sort of saying on Jesus' part forbidding divorce and/or remarriage (see below), it would be strange indeed if Jesus never provided justification for this radical prohibition. It makes good historical sense that when Jesus prohibited divorce-remarriage altogether, it raised the obvious question among either his opponents or his disciples: what about Moses (specifically the allowance for divorce in Deut 24:1-4)? Indeed, it would be amazing if the question had not been raised. It also makes good historical sense that Jesus would have appealed to one scripture text as a way of trumping another Scripture text, rather than simply revoking Moses altogether." In 10:5-6 Jesus explains that he is not abolishing the Mosaic law. Moses himself was Simply making a concession to human "hardness of heart." But how did he know that? An appeal to the way things were before the fall provides plausible grounds for overriding Moses' concession. The teaching on divorce in Matt 5:31-32, like the antitheses in general, takes a similar approach to closing the loopholes in the Mosaic law, even though an explicit appeal to God's perfect will operative pre-fall (Urzeit) and in the coming kingdom of God (Endzeit) is not made. Even if the dialogue in Mark 10:5-9 were a church creation, it would likely be an accurate reflection of the kind of reasoning Jesus employed to justify his radical utterance about divorce. Certainly, too, regardless of the historicity of 10:5-9, Jesus accepted the authority of Genesis 1-2 and its sanction of one particular model of marriage: heterosexual monogamous unions.
