The municipаlity оf Winterfield is in а stаte that has universal cоncealed carry оf firearms for all citizens who have not been convicted of a felony. But the government of Winterfield wanted to limit the concealed carry of men under 30 after 5PM because their statistics show that 90% of all crimes involving armed criminals are committed by men under 30 after 5PM. So Winterfield creates an ordinance that provides that men under 30 years of age may not carry firearms after 5PM within the city limits of the municipality. Winterfield argues that in their state there was a state law between 1864 and 1870 that made it a misdemeanor for any person to carry a firearm in public after 5PM within any the bounds of any city in the state. This was to prevent drunken wild west style gunfights, which had become so common two people were dying every day on average. Some southern states banned ghuns in cities during the end of the 1800’s. Some laws had curfews on firing guns (with exceptions for emergencies) , but not mere carrying. Peterson is arrested for carrying concealed a Bersa Thunder pistol in Winterfield after 9PM while walking his small dog. Peterson says he was carrying the pistol because a few nights earlier a masked person had tried to break into his home. Peterson was afraid the figure intended him harm. Pаtrick wаs аn 18-year оld high schооl senior who enjoyed playing pranks on those living in his neighborhood.  Dan is a 70-year old retiree who enjoys gardening and lives in the same neighborhood as Patrick.  Dan installed a large 3-tiered fountain in his front yard area.  Patrick noticed the 3-tiered fountain.  One day, Patrick rode his skateboard down the sidewalk in front of Dan’s home, and as he passed Dan front yard, Patrick threw a dissolvable soap packet into Dan’s fountain.  As a result, the fountain became a huge pile of soap bubbles.  Dan was forced to go to the time and trouble of cleaning up the mess caused, and also to clean out the fountain, pump and hose lines.  As Dan was working on the fountain, Dan’s neighbor from across the street, Lois, came over and told Dan that she had seen Patrick throw the soap packet into the fountain. A couple of days later, Patrick again came riding along the sidewalk in front of Dan’s house.  Dan was out raking leaves and when Dan saw Patrick he threw his rake on the sidewalk ahead of Patrick.  When Patrick’s skateboard hit the rake, Patrick was thrown forward off the skateboard.  Patrick screamed as he was launched into the air.  Patrick landed on the sidewalk striking his head and was rendered unconscious.  Dan then dragged Patrick into his backyard and locked Patrick in a gardening shed.  Dan then walked back into his front yard intending to walk to Patrick’s house and tell Patrick’s parents what Patrick had done to his fountain.  As Dan re-entered the front yard area, he was approached by his neighbor from across the street, Lois, who said she had seen Dan throw his rake in front of Patrick’s skateboard, and then drag Patrick to the backyard and lock him in the gardening shed.  Lois warned Dan, that, “Patrick is extremely claustrophobic.  When he wakes up he is likely to panic”.  Dan simply responded that he did not care and that it served Patrick right.  Dan then walked to Patrick’s home and reported the fountain incident to Patrick’s mother.  Patrick’s mother returned with Dan to Dan’s home.  When they arrived, they found Patrick shaking and crying in the gardening shed.  Patrick had also vomited due to fright. Patrick’s mother took Patrick home, but the next day, in retaliation, Patrick returned to Dan home and threw a rock over Dan’s front yard which shattered Dan’s front window. Discuss all intentional tort causes of action available to Dan against Patrick, and all intentional tort causes of action available to Patrick against Dan.

Jоrdаn аnd Alex hаd been dating fоr twо years and were struggling financially after both lost their jobs. One evening, while driving around town, Jordan suggested that they “get some quick cash” by stopping at a small, independently owned gas station that appeared empty except for a lone attendant, Sam. Alex laughed nervously but did not object. Before entering the station, Jordan took a large knife from the backseat and said, “Just in case things go bad.” Alex hesitated, so Jordan told her to stay in the car. Jordan approached the counter and demanded that Sam hand over the cash from the register. Sam refused and reached for a phone behind the counter. At that point, Jordan swung the knife at Sam, he missed the first time although he got dangerously close to Sam’s head. Jordan swung again and cut off Sam’s ear. Jordan quickly grabbed $600 from the open cash register while Sam lay on the floor yelling for help. As he was leaving, Jordan noticed several cartons of cigarettes behind the counter and stuffed them into a backpack, but he dropped the backpack as he was running out. As Jordan was running to his car, a police officer pulled up. Officer James quickly assessed what was going on and ordered Jordan to stop. Jordan ran towards Officer James with the knife and started to attack him. During the struggle Officer James shot his service weapon and it hit Alex, killing her instantly. Jordan fled in his vehicle and was arrested the next day. Discuss all crimes that Jordan may be charged with.
