Kelly, а mаrried public-schооl teаcher, in her late twenties, became invоlved serval years ago in an affair with Mr. Belding, her principal at Bayside High School. Kelly broke off the relationship after counseling her minister Zack Morris. Since that time Mr. Belding has attempted to continue the affair. A few days later, however, she received notice from West Beverly High School that upon reconsideration her application had been finally rejected. In a memo to Bayside School announcing the departure of Kelly, Mr. Belding revealed that Kelly had previously given a son up for adoption when she was a teenager. This was a very private painful experience she had only shared with Mr. Belding. Kelly was advised by Ms. Teasley a West Beverly official that in response to West Beverly’s inquiry, Mr. Belding had reported that Kelly was a woman of poor morale character who often appeared at work with alcohol on her breath and had stolen supplies. The West Beverly official stated that her application had been rejected based on the information supplied by Mr. Belding. In fact, Kelly has never appeared at work with alcohol on her breath nor stole supplies. Kelly commences an action against Mr. Belding seeking damages. Kelly alleged that she is not unable to find employment with other schools because schools routinely make inquiries about former school employees. The only job she can find is that of a waitress as 2/3 the compensation she could earn as a teacher. She has also been seeking medical help because of the fear and emotional trauma she has suffered and is continuing to suffer embarrassment and humiliation. To get back at Kelly, Mr. Belding filed a counterclaim for defamation against her. He knew that he had no chance of winning but filed the counterclaim to spite Kelly. The case was dismissed with prejudice based on lack of foundation and no probable cause. Please discuss what actions Kelly may bring against Mr. Belding, damages, and any applicable defenses.
