Kelly was advised by Ms. Teasley a West Beverly official that in response to West Beverly’s inquiry, Mr. Belding had reported that Kelly was a woman of poor morale character who often appeared at work with alcohol on her breath and had stolen supplies.  The West Beverly official stated that her application had been rejected based on the information supplied by Mr. Belding.  In fact, Kelly has never appeared at work with alcohol on her breath nor stole supplies. Kelly commences an action against Mr. Belding seeking damages.  Kelly alleged that she is not unable to find employment with other schools because schools routinely make inquiries about former school employees.  The only job she can find is that of a waitress as 2/3 the compensation she could earn as a teacher.  She has also been seeking medical help because of the fear and emotional trauma she has suffered and is continuing to suffer embarrassment and humiliation. To get back at Kelly, Mr. Belding filed a counterclaim for defamation against her.  He knew that he had no chance of winning but filed the counterclaim to spite Kelly.   The case was dismissed with prejudice based on lack of foundation and no probable cause.
