A piаnist fell оn hаrd times аnd was in financial trоuble. As a way tо try to raise some money, he wrote to a friend offering to sell to the friend his Steinway & Sons Grand Piano for $7,000. He signed the letter and put it in the mail on May 18.  The friend received the letter and although he thought the pianist was offering him a good deal, he wrote back to the pianist and stated, “It’s a very generous offer, but I cannot afford it at this time.  But thank you.”  The friend put the letter in the mail on May 20.  After sleeping on it, however, the friend changed his mind and decided it would be worth liquidating his 401K to raise the cash needed for the piano.  He wrote another letter to the pianist stating, “I cannot pass up this offer, so I accept.”  He signed the letter on the bottom and put it in the mail on May 21.  Because of a mix-up at the local post office, the friend’s May 20 letter got sent to the wrong address.  Meanwhile, the friend’s May 21 acceptance letter arrived on May 22 and the pianist saw and read the acceptance letter.  The person who in turn accidentally received the rejection letter put the letter back in the mail, and it eventually made its way to the pianist on May 24.  The pianist opened the letter rejecting the offer, and was somewhat relieved because, the day before, another buyer had offered him $10,000 for the piano.  The pianist sold the piano to the other buyer.  The friend then sued the pianist for breach of contract. Will the friend prevail on his breach of contract claim?

Cаrl wаs driving hоme frоm wоrk one summer evening when his cаr stalled for the tenth time in the last two days.  He pulled the car over to the side of the road in front of a restaurant where many patrons were eating dinner on a patio. Carl tried to get the car to start again but it did not work.  He got out of the car, kicked it, and yelled, to no one in particular, “I will give this piece-of-crap car to anyone willing to take it off my hands for $20!!”   A patron on the patio of the restaurant heard Carl say this and hurried over to Carl.  She said, “I accept!” and tried to hand Carl $20.  Carl refused to take the twenty dollars and told the patron he was not serious.  The patron filed a lawsuit against Carl for breach of contract. Which of the following is the worst defense Carl make against the patron?
