Bаckgrоund Fаcts    The Oklаhоma State Department оf Licensing (the "OSDL") was created by a vote of the people through the Initiative Petition process that added an article to the state constitution to create the OSDL.  The language in the Oklahoma constitution ("OSDL Amendment") provides as follows: 1)    The OSDL is governed by a five (5) member board ("OSDL Board").  Each OSDL Board member is appointed by the governor of Oklahoma and must be confirmed by the Oklahoma State Senate.  The OSDL Board is the "Administrative head" as defined by 75 O.S. § 250.3.  2)    The Oklahoma legislature is authorized, by the OSDL Amendment, to create a statute ("OSDL Act"), to enable OSDL to promulgate rules for the issuance of licenses for professionals, occupations, manufacturing activities and agricultural activities.  The OSDL Act has a schedule of fines and fees.  The OSDL Act authorizes OSDL to create rules to enforce those fines and fees.  The OSDL Act authorizes the OSDL Board to hire professional staff to run the agency. The Oklahoma legislature has enacted the OSDL Act and it was signed into law by the governor of Oklahoma.  The OSDL act is now effective.  The OSDL Act provides in part that OSDL is covered by both Article I and II of the Oklahoma Administrative Procedure Act ("OAPA").   Question 9.OSDL maintains a "Nurse Aide Registry" as required by Oklahoma and federal law.  If a "licensed" nurse aide commits a violation of Oklahoma law, OSDL conducts a hearing to determine whether a notice of violation should be placed in the official Nurse Aide Registry.  An official notice of violation by a "licensed" nurse aide prohibits any facility receiving Medicare and/or Medicaid from employing that nurse aide.  OSDL filed a petition to commence an individual proceeding under the OAPA against Michael Nurse ("Nurse"), a "licensed" nurse aide.  Nurse's hearing was held before an OSDL hearing examiner.  The OSDL hearing officer made the final agency decision to place a notice of violation by Nurse on the Nurse Aide Registry.  The OSDL Board did not hear the case or review the decision.  You represent Nurse.  What arguments can you make on his behalf?
