On hot days, it was normal for many people to wade in the pool. Some people also sailed small toy boats of various kinds in the pool. Both these activities had gone on without incident for longer than anyone could remember. On August 15, 2025, some college students on vacation thought it would be fun to go canoeing in the pool. They brought an 18-foot-long aluminum canoe to the pool. Their play got out of hand, and the students in the canoe rammed some other students who were wading. No one was offended or seriously hurt, but the city council was afraid this kind of thing could lead to serious injuries, so, on August 16, 2025, they passed a city ordinance that said "No boats, canoes, kayaks, or other watercraft shall be allowed in the park wading pool on penalty of a $500 fine." The next day signs were put up in the park with the ordinance on them. 19-year-old Danny had not heard of the new ordinance. On August 17, 2025, he went to the park with his two-foot-long radio-controlled model battleship. When Danny reached the park, he saw the signs. Danny was trying to decide if the ordinance covered his tiny battleship or not when he heard a scream. A girl was out in the middle of the pool wading and was being attacked by a two-foot-long snapping turtle. Danny put his toy ship in the pool and steered it out to bump the turtle. This distracted the turtle, who forgot the girl and began to attack the toy ship. The girl was able to escape the turtle and return to shore unharmed. A city police officer who witnessed the rescue served Danny with a summons and a $500 ticket for violating the ordinance forbidding watercraft in the wading pool. Write a court opinion from the perspective of one or more of the theories we studied (say which ones), for or against convicting anyone. Also write a dissent using one or more of the theories we discussed, defending the opposite outcome from the majority opinion.
