In eаrly 2021 Pаtriciа, an eighteen-year-оld attended a party at the newly оpened RedDirt Ranch Gоlf and Country Club ("RedDirt"), in Enid, Oklahoma. The sponsor of the party, MeetUp, Inc., (" MeetUp") had leased the entire two-story banquet and bar area from Red Dirt. MeetUp holds such parties from time to time in order to advertise its services. RedDirt had recently purchased and renovated the property in preparation for opening it to the public. Prior to its current opening, the facility had been a private insurance company office building. MeetUp, Inc. was permitted by lessor RedDirt to both supply and serve attendees beverages including wine and beer. Attendees were checked for identification upon entering RedDirt by MeetUp members, and those guests who were twenty-one or older were marked with an "X" on the back of the hand. Patricia presented a false identification card and received an "X" on the back of her hand and was admitted to the party when she arrived. RedDirt as lessor and Meetup as lessee were jointly responsible for the event. MeetUp served beer and wine from open, unsupervised tables in the second-floor bar area. Patricia repeatedly helped herself to beer and wine and became seriously intoxicated. She eventually started speaking in a very loud and obnoxious tone to party-goers. Upon being confronted by a few MeetUp members about her obviously intoxicated state, one of its employees reached toward Patricia's arm to take hold of it order to escort her out of the building. Patricia, who was quite tall, stepped quickly backwards a few steps and tumbled over a 3-foot second floor balcony railing to the marble floor fifteen-below. Patricia was immediately attended to by employees of RedDirt country club. One of these employees, Robert, was an independent contractor safety officer for the facility hired by RedDirt. Being called by management to the scene, he found Patricia in an unconscious and incapacitated state on the floor. He lifted her from the marble floor and set her body on a banquet table. Unfortunately, Patricia's spine and neck vertebrae had been severely injured in the fall, and Robert's movement of her body caused even more nerve damage and paralysis. When EMTs (emergency medical technicians) finally arrived, they properly secured Patricia's head, neck, and spine. They transported her to OU Hospital Emergency Room. Upon admission to the hospital, emergency surgery was performed on Patricia by neurosurgeon Dr. Hughes, a neurosurgeon at OU. During a brief discussion with Patricia's parents just prior to surgery, Dr. Hughes explained to them that Patricia's injury was in a very delicate cerebral location and surgical repair might result in further injury to her brain, neck and/or spine. Patricia's parents decided that because of the risk of further injury, they did not want Dr. Hughes to do any surgical repairs but instead just to stop the bleeding in her brain. Dr. Hughes, however, believed that Patricia was in serious danger of death due to cerebral bleeding, and her parents were too conservative. Without their consent, during the surgery he not only stopped the bleeding but successfully made all repairs medically possible to her neck and spine without causing further injury. Unfortunately, Dr. Hughes inadvertently left a small surgical sponge in her skull that needed to be surgically removed the next day. The added pain caused by this second surgery was significant and delayed her recovery. After awakening from the second surgery and a few days of recuperation in the hospital, care of Patricia was taken over by Dr. Randy Gormley, an OU hospital employee. He had recently returned from the Republic of the Congo on an OU hospital paid medical leave Mission trip with Médecins Sans Frontières "Doctors without Borders." Everything was going well, and Patricia was ready to be discharged, when suddenly both Dr. Gormley and Patricia came down with high fever, severe headache, fatigue, and unexplained bleeding from the mouth, ears, and eyes. It was eventually discovered that Dr. Gormley had been infected with the Ebola virus just prior to leaving Africa, and he unknowingly passed the Ebola virus to Patricia during his treatment of her in OU Hospital. While it was the customary for medical organizations to have a 30-day quarantine for medical staff returning from Ebola infected areas, Dr. Gormley disregarded this precaution and left quarantine after only 15 days. While Dr. Gormley did not survive his infection with Ebola, Patricia eventually made a near perfect recovery except that the Ebola virus left her with permanent hearing loss in her left ear. Patricia and her parents come to see you, their family tort attorney, hoping you might help her in seeking recovery for some or all of her $750,000 in hospital bills, and also compensation for her lost hearing, considerable pain and suffering from the whole ordeal. After some initial research you discover the following statutory provision that may have some bearing on your evaluation of Patricia's case: 24 Okla.Rev.Stat. § 121 Railings for residential decks require a minimum height of 36 inches from the floor of the deck to the rail's top surface. Railings in commercial buildings open to the public require railings at a minimum of 46 inches from the floor, as regulated by the Interstate Building Code ("IBC") Discuss the rights and liabilities of the parties. (70 pts) In addition, in concluding your analysis of this fact pattern, incorporate with reference to specific facts some discussion of Judge Cardozo's and Judge Andrew's differing approaches to proximate causation and how they might be reflected in your overall analysis of liability in this factual scenario.
