¶ F. [As before] ¶ G A trial was held, and the jury found Chef Liverpool guilty of battery, but not guilty of murder. Not happy with the result, the State’s Attorney considered charging Liverpool with manslaughter, a lesser form of murder.¶ H The Tazewell County State’s Attorney also considered bringing charges against Pru Berry on the notion that Pru should have known that the flour contained anthrax, or at least did not carefully supervise her ingredients allowing them to be contaminated.Unsure what charges, if any, should be brought, a panel of 23 citizens heard from the police detectives who investigated the case, reviewed the evidence from the investigation, and found probable cause to charge Pru with conspiracy and negligent homicide.Pru was able to hire her own attorney, Emeril Legalsee, to represent her in court. After a two-day trial, the judge presiding over the case found Pru not guilty of the charges. What would be the burden of proof required in these cases?

¶ F. The Tazewell County State’s Attorney brought charges against Chef Liverpool who was accused of adding the anthrax powder to Pru’s flour. Liverpool was charged with battery and intentional murder in the injury and death of the celebrity judge. Chef Liverpool lost his job at ICC because of the accusation, so he was provided an attorney to represent him. During jury selection for the trial, Chef Noel Leith happened to be called for jury duty, but did not serve on the jury because of his familiarity with the parties and many of the facts of the case. Prof. Paulsen was also called for jury duty, but he was not selected by either attorney because, although he could be fair and unbiased, they both believed he is a “know-it-all-professor” and no one wants one of those on a jury. While the jury in this case found the defendant guilty, the surviving family or estate of the deceased celebrity judge would have a cause of action also against Chef Liverpool. The area of law that would apply to the case of the estate of the celebrity judge versus Liverpool is:

¶ L. Other legal paperwork followed.Child served Pru with a series of 50 questions asking about her training, where she got her ideas, who worked with her in the Monterey kitchen, and many more written questions seeking information. Child also served Pru with a request for things such as the Bombe Tart recipe itself, photos of the Monterey kitchen facilities, a list of all customers to whom Bombe Tart orders were received and shipped, and accounting documents for PruBerrys business. Many months after that, Garcon’s attorney, Julian Child arranged to interview Pru under oath with attorney Legalsee and a court reporter present, to ask questions and get answers on the record in anticipation of trial. Finally, Child sent Legalsee a request that he admit several of the allegations contained in the original pleading that started the case that were denied in the response to that original pleading by Pru through her attorney Legalsee. [Note: ¶ L. will be referenced in the next 4 questions that follow, but the content will not be repeated.] This paragraph shows what is known in litigation as the _____ stage.
