Cоnsider the fоllоwing scenаrio аnd tort аctions -- The Baltimore Orioles are playing the New York Yankees in the final game of the American League Championship series. The game is being held at Oriole Park at Camden Yards , and the series is even at three games apiece. Adam, a loyal Orioles fan, took his seat with a Natty Bo beer and hot dog in hand. As he was celebrating, Adam attempted to “high five” another fan, however, due to his drunken state, he missed the fan and hit Yankees outfielder, Aaron Judge, in the back of the head, causing a large gash. Judge was so angry that he responded by punching Adam in the face, knocking him unconscious. Finally, field personnel got the crowd under control and play resumed.  However, not long into the 9th inning, another hooligan, Phil, jumped onto the field of play, and began to run around the field to the wild cheers of the crowd.  During the course of his running, he stepped onto a piece of a metal cleat that had broken off a shoe and suffered a cut that would later require stitches.  With Phil slowed by the cut, field personnel were finally able to catch him and escort him off the field.   In the aforementioned scenario -- If Judge were not able to claim self defense for his hit on Adam, because of the nature of the hit, it would be considered battery.
