Jоshuа investigаtes the effect оf vаrying amоunts of sunlight on the rate of plant growth. He experiments by exposing seedlings to different amounts of sunlight each day. All seedlings are given the same amount of water and are planted in the same type of soil. He stops the experiment when each seedling reaches 20 cm in height. Which variable is an independent variable in Joshua’s experiment?

Questiоn 3 Yоur client, Green Agriculture Ltd (GREEN), filed а Eurоpeаn pаtent application ten months ago directed to an agricultural irrigation pipe for supplying water to farmland. The pipe has a novel cross-section that surprisingly improves irrigation efficiency. GREEN's application did not include a claim to priority. Six months ago, GREEN made full disclosure of a complete working prototype of their invention at a trade fair in Dorset, England. The prototype garnered considerable attention from farm owners from around the world and several significant orders for the technology have already been received. Following the trade fair, a German competitor company, BLAUE Landmaschinen GmbH (BLUE), wrote to GREEN to draw attention to the following: A soon to-be-published European patent application filed by BLUE two days before the filing date of GREEN's patent application. BLUE's application discloses pipes having the novel cross-section for delivering fuel to a farm-vehicle engine. A five-year-old article published in Japanese describing the repurposing of fuel delivery pipes for the delivery of fresh water. In their letter, BLUE asserts that GREEN's patent application cannot be granted, and that BLUE is proceeding to manufacture irrigation pipes with the novel cross-section for sale in the highly lucrative vineyard markets of the UK, Germany and California in the USA. GREEN is concerned that BLUE may undercut or exclude them in these vineyard markets.   Advise GREEN on: The prospect for grant of GREEN's European patent application; and What strategy for patent protection should GREEN adopt to ensure they are able to supply irrigation pipes to vineyards in the UK, Germany, USA and potentially other markets? At the trade fair, one British competitor – Red Irrigators Ltd (RED) – showed particular interest in GREEN's invention. Following the trade fair, RED adapted their website to indicate they are developing a new irrigation pipe having a cross-section that is a very minor modification of the cross-section of GREEN's invention. In fact, RED compare their pipes with GREEN's pipes on their website and conclude that RED's pipes are only 0.1% less efficient than GREEN's pipes. RED also mention that they have filed their own UK patent application in the past week directed to irrigation pipes with RED's modified cross-section.   Advise GREEN on: Whether RED's products in the UK will infringe GREEN's patent if granted; and Whether RED might ultimately be granted a patent, considering the state of the art set out in section above, and whether there is anything GREEN can do to influence this prospect.
