Plаintiff sued Defendаnt fоr breаch оf cоntract. Plaintiff alleged it was widely reputed to be engaged in the business of developing, exploiting and commercializing inventions for the mutual benefit of inventors and Defendant. At trial, Defendant asserted that the alleged contract lacked consideration, because it had no mutuality of obligation and was void and unenforceable. Defendant claimed that the promise by Plaintiff was illusory because Plaintiff actually assumed no duties to market and sell Defendant’s product and nothing in the contract obligated Plaintiff to do anything. Plaintiff claimed the contract was supported by consideration and enforceable. Please discuss Defendant’s argument in light of the facts and applicable law and provide your opinion as to how the matter would be decided by the trial judge.
