You should use IRAC to frame your answer when appropriate. Max Vladkovic was born in Romania. He immigrated to the United States, obtained citizenship, and took up residence in Michigan. Vladkovic was hired by Ship-R-Us as a full-time employee in 2009 and was terminated in 2023. Vladkovic contends that throughout his 14-year employment with Ship-R-Us, he was subjected to frequent and ongoing discrimination based on his national origin. Vladkovic alleges he was repeatedly called insulting names and subjected to vulgar language by his co-workers. For example, co-workers referred to him with insults and name-calling, such as “s**mbag,” “pyromaniac,” “piece of a**,” “piece of s***,” “stupid a**h***,” “sheep f***er,” and “Russian d*** h***.” According to Vladkovic, Ship-R-Us supervisory personnel also engaged in coarse and bigoted language directed against him at work. In 2013, there was an incident where Vladkovic confronted a former supervisor who called him a “dirty Commie." In 2021, another Ship-R-Us supervisor rudely called him a “f***ing foreigner” and commented, with respect to civil unrest in Romania during the 1980’s, “It seems to me all Romanians are barbarians.” The undisputed facts at trial establish that Vladkovic engaged in similar insulting behavior, calling his co-workers vulgar names, although usually in response to their offensive comments. In November 2023, citing his "vulgar language and confrontational attitude despite several warnings to be more cooperative," Ship-R-Us terminated Vladkovic "for cause." Following the termination, Vladkovic called and sent multiple emails to Ship-R-Us, complaining that he was not given a chance to tell management that he never received any written warnings before the firing, citing language in the Employee Handbook that read: “Employees may be disciplined, up to termination, after a verbal and a written warning.” Ship-R-Us ignored all communications from Vladkovic. In February 2024, Vladkovic filed suit in U.S. District Court against Ship-R-Us, requesting money damages and declaratory or injunctive relief aimed at preventing Ship-R-Us (and through example, other employers) from engaging in such discriminatory conduct. Among the allegations were: 1) Discrimination by Ship-R-Us against Vladkovic because of his national origin (a violation of Title VII of the Civil Rights Act); and 2) Failure by Ship-R-Us to give a written warning before terminating Vladkovic, despite the Employee Handbook promising such a warning prior to disciplinary action.
