Wolfish (1979) The Court ruling adopted the punitive intent standard, stating that the case should turn only on whether the practices in question violated the detainees’ right to be free from punishment, using a standard of whether the individual restrictions were punitive or merely regulatory restraints, whether the practice is reasonably related to a legitimate goal other than punishment, and whether it appears to be excessive in relation to that alternative purpose. The Court found that if people of reasonable sensitivity found the treatment shocking or disgusting, it would be considered cruel and unusual. The Court developed the test of proportionality by declaring that, “A criminal sentence must be proportionate to the crime for which the defendant has been convicted…a court’s proportionality analysis…should be guided by objective criteria.”

There were twо fаctоrs thаt led to the resurgence for the support of rehabilitative programs; one of the factors was that with tightening government budgets, officials are recognized that we cannot continue to ”recycle” offenders through correctional programs only to have them continue to fail when returned to the community.
