Of the ten women, eight learned from the independent doctors that they did not need cataract surgery.  One of the doctors said that she thought it would be malpractice to recommend or perform cataract surgery on any of the patients.    A few weeks later, Harriet's news expose airs.  It shows the Desnick doctors telling Harriet and the other volunteers they needed surgery and independent doctors saying they didn't.  They also interviewed former Desnick employees who said Desnick preyed on Medicare recipients, billing for millions in unnecessary surgery.   When the special airs, Desnick sues Harriet and WKOKO for, among other things, trespass.  At trial, the court finds the defendants liable for damages resulting from trespass.  WKOKO appeals.   You are a clerk for the Appellate Judge.  Draft a memo for your Judge explaining how you think the case should come out.  Cite relevant precedent, and any policy you think applicable.
